In the second section of Chapter V of The concept of law, Hart lays down the concept of legal obligation throughout a critique of the concept of obligation in John Austin’s predictive theory. The critique aims at the core domain of this theory, which occupies the major part of the section, and shows how wrong it is to describe the legal obligation in terms of commands and habits of obedience. At the end of this section, Hart introduces the concepts of (...) internal and external point of view, in order to criticize the methodological model used by the predictive theory – the great responsible for the mistakes of Austin’s account. The following paper makes a review of the “debate” between both theories and, at the end, it tries to demonstrate how the introduction of Hart’s new conceptions (internal and external points of view) is done to avoid the mistakes occurred in Austin’s predictive theory. RESUMONeste ensaio defende-se o argumento de que a configuração cronotópica potencializa a obra literária como forma metafórica para experimentar a vida cotidiana. Esse argumento apoia-se nas declarações em que Bakhtin destacou que a organização de processos psicológicos de personagens no enredo está relacionada com a experiência da unidade tempo-espaço, conceitualmente denominada de cronotopo. Para exemplificar essas questões desenvolveu-se aqui uma análise da configuração cronotópica do autor-personagem no Livro do desassossego de Fernando Pessoa. A dificuldade do autor-personagem para negociar as posições (...) de figura e fundo no seu pensamento refletiu uma experiência de fronteira específica, revelada na frequente associação de termos antagônicos e uso frequente de neologismos. Percebendo o funcionamento cronotópico da narrativa, discute-se o potencial da literatura na provisão de metáforas para vida real. Nessas considerações chamou-se a atenção para a participação do leitor na constituição do cronotopo e da obra.ABSTRACTIn this essay we defend the argument that chronotopic configuration enhances literary works providing metaphors for everyday life. This argument is embedded in statements in which Bakhtin emphasized that the organization of the characters' psychological processes in plots is related to the experience of temporal-spatial unity, conceptually called the chronotope. In order to address these issues, we developed an analysis of chronotopic configuration of author-character, in "The Book of Disquiet" by Fernando Pessoa. The difficulty met by the author-character in negotiating positions of figure and background in plots reflects a specific border experience, revealed in the common association of antagonistic terms and frequent use of neologisms. Considering properties of narrativity in the chronotopic analysis we can discuss the potential literature has of providing real life metaphors. Moreover, through these remarks, greater emphasis has been placed on the reader's participation in the constitution of the chronotope and on literary work. (shrink)

Morality has traditionally been described in terms of an impartial and objective “moral law”, and moral psychological research has largely followed in this vein, focusing on abstract moral judgments. But might our moral judgments be shaped not just by what the action is, but who is doing it? We looked at ratings of moral wrongness, manipulating whether the person doing the action was a friend, a refugee, or a stranger. We looked at these ratings across various moral foundations, and conducted (...) the study in Brazil, US, and UK samples. Our most robust and consistent findings are that purity violations were judged more harshly when committed by ingroup members and less harshly when committed by the refugees in comparison to the unspecified agents, the difference between refugee and unspecified agents decays from liberals to conservatives, i.e., conservatives judge them more harshly than liberals do, and Brazilians participants are harsher than the US and UK participants. Our results suggest that purity violations are judged differently according to who committed them and according to the political ideology of the judges. We discuss the findings in light of various theories of groups dynamics, such as moral hypocrisy, moral disengagement, and the black sheep effect. (shrink)

The book, written in a clear, engaging style, contains four chapters.

This essay argues for a model of pictorial representation which aims to explain the relationship between pictorial content and pictorial accuracy. Focusing on cases where pictures are intended to convey accurate information, the model distinguishes between two fundamental representational relations: on one hand, a picture expresses a content; on the other, it aims at a target scene. Such a picture is accurate when the content it expresses fits the target scene it aims at. In addition, the model follows the traditional (...) division of content into two aspects: singular content specifies the particular individuals which a picture is of, and attributive content specifies the properties and relations which the picture ascribes to those individuals. For a picture to be accurate, both aspects must be matched in the target. I call this the Three-Part Model because it distinguishes between the triad of factors, singular content, attributive content, and target, which together determine pictorial accuracy. Though previous work on depiction has not recognized the distinctive role played by target, I will argue that it is essential in order to make sense of accuracy judgements across a range of central cases. Gabriel Richardson Lear presents a bold new approach to one of the enduring debates about Aristotle's Nicomachean Ethics: the controversy about whether it coherently argues that the best life for humans is one devoted to a single activity, namely philosophical contemplation. Many scholars oppose this reading because the bulk of the Ethics is devoted to various moral virtues--courage and generosity, for example--that are not in any obvious way either manifestations of philosophical contemplation or subordinated to it. They argue that (...) Aristotle was inconsistent, and that we should not try to read the entire Ethics as an attempt to flesh out the notion that the best life aims at the "monistic good" of contemplation. In defending the unity and coherence of the Ethics, Lear argues that, in Aristotle's view, we may act for the sake of an end not just by instrumentally bringing it about but also by approximating it. She then argues that, for Aristotle, the excellent rational activity of moral virtue is an approximation of theoretical contemplation. Thus, the happiest person chooses moral virtue as an approximation of contemplation in practical life. Richardson Lear bolsters this interpretation by examining three moral virtues--courage, temperance, and greatness of soul--and the way they are fine. Elegantly written and rigorously argued, this is a major contribution to our understanding of a central issue in Aristotle's moral philosophy. (shrink)

A semantics of pictorial representation should provide an account of how pictorial signs are associated with the contents they express. Unlike the familiar semantics of spoken languages, this problem has a distinctively spatial cast for depiction. Pictures themselves are two-dimensional artifacts, and their contents take the form of pictorial spaces, perspectival arrangements of objects and properties in three dimensions. A basic challenge is to explain how pictures are associated with the particular pictorial spaces they express. Inspiration here comes from recent (...) proposals that analyze depiction in terms of geometrical projection. In this essay, I will argue that, for a central class of pictures, the projection-based theory of depiction provides the best explanation for how pictures express pictorial spaces, while rival perceptual and resemblance theories fall short. Since the composition of pictorial space is itself the basis for all other aspects of pictorial content, the proposal provides a natural foundation for further pictorial semantics. (shrink)

We criticize attempts to define hope in terms of other psychological states and argue that hope is a primitive mental state whose nature can be illuminated by specifying key aspects of its functional profile.

Several philosophers have argued recently that semantic properties do play a causal role. 1 It is our view that none of these arguments are satisfactory. Our aim is to reveal some of the deficiencies of these arguments, and to reassess the question in our own way. In section 1, we shall explain in more detail what is involved in the pretheoretical idea of a causally efficacious property and so provide a fuller sense of the issue. In section 2 we shall (...) discuss Fodor's and Kim's arguments that the semantic properties of mental events are causally efficacious. Their tactic is to articulate sufficient conditions for the causal efficacy of a property, and then apply these conditions to the psychological properties under consideration. We shall show that both formulations are inadequate. However, each account can remedy some of the defects of the other. We shall argue that by putting the two together, and modifying this combined account in certain ways, we can arrive at something that might just pass as a general sufficient condition for causal efficacy. We believe that the question of causal efficacy of content is best approached as a question in the philosophy of science. If one wants to know whether a given species of property is efficacious, the most productive strategy is to find a science that investigates the properties and examine the role they are assigned. In keeping with this attitude we shall restrict our discussion to the notion of content deployed within cognitive science. In section 3 we examine the role of content in cognitive science and discuss whether this role suits content to the conditions on efficacy articulated in section two. Our conclusion will be conditional and hedged: on certain views of cognitive science, content will meet the sufficient condition for efficacy. If other views are correct, the question remains open. Groups are ubiquitous in our lives. But while some of them are highly structured and appear to support a shared intentionality and even a shared agency, others are much less cohesive and do not seem to demand much of their individual members. Queues, for example, seem to be, at a given time, nothing over and above some individuals as they exemplify a certain spatial arrangement. Indeed, the main aim of this paper is to develop the more general thought that at (...) a given time, a group is nothing over and above some individual members as they exemplify a certain complex condition. The general conception of groups that emerges is able to accommodate a variety of constraints on a reasonable answer to the question of what are groups. (shrink)

Philosophers often explain what could be the case in terms of what is, in fact, the case at one possible world or another. They may differ in what they take possible worlds to be or in their gloss of what is for something to be the case at a possible world. Still, they stand united by the threat of paradox. A family of paradoxes akin to the set-theoretic antinomies seem to allow one to derive a contradiction from apparently plausible principles. (...) Some of them concern the interaction between propositions and worlds, and they appear to afford the means to map classes of propositions into propositions – or, likewise, classes of worlds into worlds – in a one-to-one fashion that leads to contradiction. Yet another family of paradoxes threaten the view that whatever could exist does, in fact, exist, which is in line with modal realism, for example. We show from an abstract comparison principle that the Mitchell order is linear on sufficiently strong ultrafilters: normal ultrafilters, Dodd solid ultrafilters, and assuming GCH, generalized normal ultrafilters. This gives a conditional answer to the well-known question of whether a [Formula: see text]-supercompact cardinal [Formula: see text] must carry more than one normal measure of order 0. Conditioned on a very plausible iteration hypothesis, the answer is no, since the Ultrapower Axiom holds in the canonical inner models at the finite (...) levels of supercompactness. (shrink)

In recent years, many disciplines have become interested in the scientific study of morality. However, a conceptual framework for this work is still lacking. In The Moral Background, Gabriel Abend develops just such a framework and uses it to investigate the history of business ethics in the United States from the 1850s to the 1930s. According to Abend, morality consists of three levels: moral and immoral behavior, or the behavioral level; moral understandings and norms, or the normative level; and (...) the moral background, which includes what moral concepts exist in a society, what moral methods can be used, what reasons can be given, and what objects can be morally evaluated at all. This background underlies the behavioral and normative levels; it supports, facilitates, and enables them. Through this perspective, Abend historically examines the work of numerous business ethicists and organizations--such as Protestant ministers, business associations, and business schools--and identifies two types of moral background. "Standards of Practice" is characterized by its scientific worldview, moral relativism, and emphasis on individuals' actions and decisions. The "Christian Merchant" type is characterized by its Christian worldview, moral objectivism, and conception of a person's life as a unity. The Moral Background offers both an original account of the history of business ethics and a novel framework for understanding and investigating morality in general. (shrink)

Two semantic theories of proper names are explained and assessed. The theories are Burge’s treatment of proper names as complex demonstratives and Larson and Segal’s quasi-descriptivist account of names. The two theories are evaluated for empirical plausibility. Data from deficits, processing models, developmental studies and syntax are all discussed. It is concluded that neither theory is fully confirmed or refuted by the data, but that Larson and Segal’s theory has more empirical plausibility.

The topic of this paper is the semantic structure of belief reports of the form 'a believes that p'. it is argued that no existing theory of these sentences satisfactorily accounts for anaphoric relations linking expressions within the embedded complement sentence to expressions outside. a new account of belief reports is proposed which assigns to embedded expressions their normal semantic values but which also exploits frege's idea of using senses to explain the apparent failures of extensionality in the reports.

Heraclitus uses paradoxical language to present the relationship between opposites in his worldview. This mode of expression has generated much controversy. Some take the paradoxes as evidence of a contradictory identity of opposites (Barnes), while others propose a dynamic union through transformation without identity that avoids the contradiction (Graham). By examining B88 and B62, I seek to identify the stronger and weaker points of such readings. The contradictory identity reading thwarts the transformation between opposites. The dynamic reading offers a plausible (...) alternative. However, it skips a characterization of how Heraclitus conceives of the transformation between opposites in physical terms. To fill this gap, I consider Heraclitus’ use of what I call the anti-cognate internal object in B62. I argue that ‘living the death and dying the life’ is a case of change as mixture, a popular conception among the early Presocratics. Upon closer examination, the anti-cognate internal object suggests that real contradictions belong to Heraclitus conception of change. The details reveal a philosophically compelling view. (shrink)

Journal of Mathematical Logic, Ahead of Print. Given a structure [math] and a stably embedded [math]-definable set [math], we prove tameness preservation results when enriching the induced structure on [math] by some further structure [math]. In particular, we show that if [math] and [math] are stable (respectively, superstable, [math]-stable), then so is the theory [math] of the enrichment of [math] by [math]. Assuming simplicity of [math], elimination of hyperimaginaries and a further condition on [math] related to the behavior of algebraic (...) closure, we also show that simplicity and NSOP1 pass from [math] to [math]. We then prove several applications for tame expansions of weakly minimal structures and, in particular, the group of integers. For example, we construct the first known examples of strictly stable expansions of [math]. More generally, we show that any stable (respectively, superstable, simple, NIP, NTP2, NSOP1) countable graph can be defined in a stable (respectively, superstable, simple, NIP, NTP2, NSOP1) expansion of [math] by some unary predicate [math]. As we have discussed elsewhere, Franz Boas and John Dewey were intellectual and political allies at Columbia University for over thirty years.1 Dewey advocated for an increased role of anthropology for philosophical insight, and he often used anthropological knowledge as a starting point for his ethics and politics, including such knowledge as learned from Boas. We hold that Boas and Dewey shared a common core understanding of human global and evolutionary diversity, and that this shared understanding itself forms a core (...) component of their progressive projects.However, with regard to the problem of racism in the United States, Boas and Dewey had different engagements. The so-called Trolley Problem was first discussed by Philippa Foot in 1967 as a way to test moral intuitions regarding the doctrine of double effect, Kantian principles and utilitarianism. Ever since, a great number of philosophers and psychologists have come up with alternative scenarios to further test intuitions and the relevance of conventional moral doctrines. Given that physicians routinely face moral decisions regarding life and death, the Trolley Problem should be considered of great importance in medical ethics. In this article, (...) five “classic” trolley scenarios are discussed: the driver diverting the trolley, a bystander pulling a lever to divert the trolley, a fat man being thrown from a bridge to stop the trolley, a bystander pulling a lever to divert a trolley so that a fat man may be run over, and a bystander pulling a lever so that a fat man falls off from a bridge to stop the trolley. As these scenarios are discussed, relevant moral differences amongst them are addressed, and some of the applications in medical ethics are discussed. The article concludes that Trolley scenarios are not the ultimate criterion to make ethical decisions in difficult ethical challenges in medicine cases but they do serve as an initial intuitive guide. We give three counterexamples to the folklore claim that in an arbitrary theory, if a complete type p over a set B does not divide over $C\subseteq B$, then no extension of p to a complete type over $\operatorname {acl}(B)$ divides over C. Two of our examples are also the first known theories where all sets are extension bases for nonforking, but forking and dividing differ for complete types (answering a question of Adler). One example is an $\mathrm {NSOP}_1$ theory (...) with a complete type that forks, but does not divide, over a model (answering a question of d’Elbée). Moreover, dividing independence fails to imply M-independence in this example (which refutes another folklore claim). In addition to these counterexamples, we summarize various related properties of dividing that are still true. We also address consequences for previous literature, including an earlier unpublished result about forking and dividing in free amalgamation theories, and some claims about dividing in the theory of generic $K_{m,n}$ -free incidence structures. In this paper we show that first-order languages extended with partially ordered connectives and partially ordered quantifiers define, under a certain interpretation, their own truth-predicate. The interpretation in question is in terms of games of imperfect information. This result is compared with those of Kripke and Feferman.

Moral repair is an important way for firms to heal moral relationships with stakeholders following a transgression. The concept is rooted in recognition theory, which is often used to develop normative perspectives and prescriptions, but the same theory has also propelled a view of moral repair as premised on negotiation between offender and victim(s), which involves the complex social construction of the transgression and the appropriate amends. The tension between normative principles and socioconstructivist implementation begs the question how offending firms (...) should approach moral repair. Addressing this question, we develop a two-level conceptualization of moral repair, distinguishing between procedural and substantive levels of practice, which accommodate normativity and socioconstructivism, respectively. In so doing, we enrich the literature by 1) promoting conceptual clarity, 2) refining understanding of the moral repair process, and 3) suggesting the use of a unified, configurational approach to studying (nonlinear) relations between amends and moral outcomes. El presente trabajo se propone subrayar la relevancia filosófica del amor acudiendo al desarrollo analítico que del mismo realiza Harry G. Frankfurt. Para ello nos valdremos de la categorización que establece Bennett Helm y encuadraremos la teoría de Frankfurt dentro de una categoría concreta: la del amor como «gran preocupación» [«robust concern»]. Esto nos servirá para atender a la psicología moral de dicho autor y al peso decisivo que el amor juega en la misma; revestido aquel, como afirma Frankfurt, de (...) una autoridad tal que dota de sentido último a nuestro razonamiento práctico. Finalmente, y expuesta la relevancia del amor dentro de todo este proceso, se procederá a discutir de la mano de Jonathan Lear si el amor posee la autoridad que Frankfurt le asigna. (shrink)

The Russell–Myhill theorem threatens a familiar structured conception of propositions according to which two sentences express the same proposition only if they share the same syntactic structure and their corresponding syntactic constituents share the same semantic value. Given the role of the principle of universal instantiation in the derivation of the theorem in simple type theory, one may hope to rehabilitate the core of the structured view of propositions in ramified type theory, where the principle is systematically restricted. We suggest (...) otherwise. The ramified core of the structured theory of propositions remains inconsistent in ramified type theory augmented with axioms of reducibility. This is significant because reducibility has been thought to be perfectly consistent with the ramified approach to the intensional antinomies. Nor is the addition of reducibility to ramified type theory sufficient to restore other intensional puzzles such as Prior’s paradox or Kripke’s puzzle about time and thought. (shrink)

We argue that not all cases of before-effect involve causation and ask how to demarcate cases of before-effect in which the events that follow exert causal influence over the before-effect from cases in which they do not.

Concepts of decision, choice, decision-maker, and decision-making are common practical tools in both social science and natural science, on which scientific knowledge, policy implications, and moral recommendations are based. In this article I address three questions. First, I look into how present-day social scientists and natural scientists use decision/choice concepts. What are they used for? Second, scientists may differ in the application of decision/choice to X, and they may explicitly disagree about the applicability of decision/choice to X. Where exactly do (...) these disagreements lie? Third, I ask how scientists should use decision/choice concepts. What are they correctly and incorrectly used for? I argue that scientists must responsibly attend to a methodological demand: you have to have a principled, non-ad hoc, well-argued-for way of telling where decision/choice applicability ends. Thus, I aim to minimize the risk of conceptual stretching and foster responsible conceptual practices in a large body of scientific work. (shrink)

Achille Mbembe’s book Critique of Black Reason has attracted scholarly interest and commentaries. In a conversation that took place between David Theo Goldberg and Mbembe, both men discuss some of the themes that are raised in the book. This paper examines that conversation and focuses on the idea of the archive and how the dehumanisation, damage, destruction and death that racism has visited on many black people can be resurrected, dusted down and repaired. I have used Mbembe’s idea of blackness (...) as a way into the archive to retrieve and retell a particular story and, in doing so, to repair the damage to the life of an African American man, as only writing can do. I revive the humanity and dignity of that life against the brutal racism that ultimately claimed it. This is a requiem for Mr Wilson. (shrink)

Modernity’s allure has created a false belief in the idea of progress while concealing a destructive streak in human activities. He warns that there is trouble ahead unless humans chart a different course. But is this the lamentation of a Jeremiad or a timely intervention in the current state of the world?

The concept of representation in public law is attracting more and more interest; specially gives many problems in the Parliament how representation, so as a representative institution. In this place is plained a principal problem: the new function of Parliament and the roll of parliamentary's Government control. We assist to the end of the dogma of the separation of powers. So we need to distinguish between control by the Parliament and control in the Parliament; the first are less effective because (...) significate the Government control of his own majority; the second is the critical capacity of minorities against the Government; this last are a effective control who's should create public opinion. This does not imply the suppression of public representation idea. By suggesting a revision of these idea does not mean that they should disappear. It seems wise to conserve the concept of representation providing it refer to the particular situation of the autoritas and his decision, whenever he appers as a victim of the procers in which take part the after side of problem: the souveragnity. The death of George Floyd in May 2020 sparked an unprecedented global wave of protests that appeared to mark a turning point in the battle against racial injustice. But protests against racism are not new; each comes and soon passes into the archives of history, leaving few lasting changes in its wake. What was different about the death of Floyd was that the graphic manner of its unfolding was captured on film: the slow act of wilful suffocation, and how the (...) entire world was seemingly invited to witness the torment and the execution of this man, in broad daylight, even as he cried I can't breathe. However, this discussion attempts to move beyond that moment of death, the protests that followed and the distracting debate about statues and monuments to argue that the death of Floyd must be seen as the culmination of the process of systemic and structural racism. It aims to show how racism shifted from the black body as the visible and material target of racial oppression to air/breath, and how suffocation became the characteristic feature as well as the weapon of contemporary racial injustice. Independence‐Friendly logic introduced by Hintikka and Sandu studies patterns of dependence and independence of quantifiers which exceed those found in ordinary first‐order logic. The present survey focuses on the game‐theoretical interpretation of IF‐logic, including connections to solution concepts in classical game theory, but we shall also present its compositional interpretation together with its connections to notions of dependence and dependence between terms.

Trolley dilemmas have been tested cross-culturally, but only recently have researchers begun to assess the effect of responding to such dilemmas in a foreign language. Previous studies have found a Moral Foreign Language Effect in trolley dilemmas, whereby subjects who respond to these dilemmas in a foreign language, tend to offer more utilitarian responses. The present study seeks to test whether the MFLE holds amongst native speakers of Arabic. Additionally, the present study seeks to test whether the use of visual (...) images has any effect on responses. For such purposes, four groups were compared: 1) participants responding to trolley dilemmas in English without visual images; 2) participants responding to trolley dilemmas in Arabic without visual images; 3) participants responding to trolley dilemmas in English with visual images; 4) participants responding to trolley dilemmas in Arabic with visual images. Xenophon’s anecdote concerning the exchange of clothes between a big boy and a little boy in Cyropaedia offers a valuable framework for understanding his conception of justice and the problematics of administering it. Interpreters have erred by assuming that Cyrus’ teacher, as well as Socrates in Memorabilia, simply identifies the just with the lawful. Rather than identifying the two, both characters argue that the law is just; but they differ widely in their explanations of what makes the law just. For (...) Cyrus’ teacher, the obligation to observe the law rests on a universal pre-legal ban on violence; for Socrates statutory law is to be obeyed for utilitarian reasons. Socrates’ view thus justifies both the teacher’s insistence that Cyrus obey the law—since the law is of benefit to the community—and also Cyrus’ decision to violate the law to achieve a just and beneficial redistribution. But it offers no justification for a universal ban on violence. In conformity with the Socratic principle, Cyrus avoids violence as far as possible, but only for the prudential reasons expressed by his mother. The chapter presents the prototyping of a thinking routine designed to foster good inference habits in children ages 6 to 11. The prototyping was developed at Ninho, an educational project for children from underprivileged households in Brazil. The thinking routines by Ritchhart and colleagues (2006) served as our starting point. Following a Virtue Education (VE) approach, we supposed that the repeated application would conduce to habituation. In addition, to increase peer-to-peer interactions, the teacher applying the routines worked as a facilitator (...) in a Community of Inquiry (CI). After six months of application, the results were partially successful. We identified that the repeated exposition to the magic question “What makes you say that?” made children more aware of the evidence supporting their assumptions. Furthermore, the interactions between peers made them recognize different perspectives. However, we also identified some shortcomings. Most of them seemed to arise from cognitive biases. At the individual level, belief perseverance kept children too attached to their first assumptions. They preferred self-serving rationalizations instead of accepting a counter-argument. At the group level, we identified problems of social contagion such as information cascades. The effects of a first opinion rhetorically voiced were hard to efface. Since none of the steps on the previous routines addressed these biases, we prototyped a routine to start filling this gap. Following Critical Thinking (CT) theorists, we added a step of structured instruction concerning one specific reasoning technique - the inference to the best explanation. Moreover, the recommendation of cognitive psychologists motivated the inclusion of some extra features to avoid groupthink biases. For instance, a visual table that juxtaposes contrasting arguments should facilitate comparative evaluations. Also, a star-based evaluation scale should help different individuals to discuss their assessments based on a common ground. As described in the end, the prototype with elements from VE, CI and CT presented promising results. (shrink)
